In brief. Code Gardens uses third-party AI tools to train clients and create text, images, and videos. Personal data belonging to visitors, clients, or third parties is not transferred to such tools as part of prompts or files. Final materials are reviewed by a human; AI does not make decisions about individuals and does not replace professional judgement.

Purpose and Scope

This Policy explains how Plezard Ko OÜ, operating under the Code Gardens brand (hereinafter “Code Gardens” or “we”), uses artificial intelligence systems in its professional activities. The Policy applies to the codegardens.com website, content creation, and the educational services provided by Code Gardens.

This Policy supplements the Code Gardens Privacy Policy. If applicable law, an agreement with a client, or the rules of a particular AI system impose stricter requirements, the stricter requirements apply.

Code Gardens uses third-party AI systems in its capacity as a professional user (deployer). This Policy does not cover the development or placing on the market of an AI model or AI system under the Code Gardens brand. If such a scenario arises, it will require a separate assessment and an update to this Policy before its implementation begins.

How We Use AI

AI may be used for the following limited purposes:

training clients to work with AI, including demonstrations, exercises, prompt-development methods, and analysis of AI limitations;
preparing alternative versions, drafts, and editorial suggestions for texts;
creating and editing images, illustrations, visual concepts, and videos;
creative exploration and acceleration of routine content-production stages while maintaining human oversight.

As of the date of this version, the website discloses the combined use of Midjourney, Bing, OpenAI, Adobe Firefly, and Gemini. The selection of third-party services may change; their use will always remain limited by the purposes and rules set out in this Policy.

How AI Is Not Used

Within the services described above, Code Gardens does not use AI:

to make fully automated decisions that produce legal effects or similarly significant consequences for an individual;
to assess candidates, determine access to services, set individual prices, or assess creditworthiness or insurance risks;
for emotion recognition, biometric categorisation, social scoring, or the covert manipulation of individuals;
to provide medical, legal, or financial diagnosis or advice without a qualified professional;
to provide a public AI chat or an autonomous AI assistant on the website without a separate and clearly visible notice to the user.
Human Oversight and Responsibility

AI produces probabilistic results and may provide inaccurate, outdated, biased, or fabricated information. Therefore, an AI-generated result is not published or delivered as a final material solely on the basis of the system’s response.

Depending on the task, the responsible Code Gardens specialist:

defines the objective and the permitted source materials;
verifies facts, calculations, sources, context, and compliance with the assignment;
edits textual and visual materials and assesses the risk of producing a misleading result;
makes the publication decision and assumes editorial responsibility for the published material;
involves the client in the approval process when the result is created for a client project.
Personal Data and Confidentiality

Code Gardens does not enter or upload the personal data of visitors, clients, training participants, or third parties into the generative AI services it uses as part of prompts, files, or project materials. This includes, in particular, names, contact details, identifiers, payment information, correspondence, health information, biometric data, voice recordings, and recognisable images of individuals.

Data submitted by users through website forms, during payment or subscription processes, or in correspondence is processed in accordance with the Privacy Policy and is not forwarded to generative AI services for content creation.

Work involving AI uses synthetic data, anonymised materials, publicly available non-personal information, or materials that Code Gardens or the client has the right to use.

Confidential client information is not transferred to a third-party AI service. If a future task objectively requires the processing of personal data using AI, Code Gardens will conduct a separate assessment of lawfulness, necessity, risks, contractual terms, retention periods, security, and international data transfers before processing begins. No data will be transferred to an AI service until that assessment has been completed.

If personal data is accidentally included, Code Gardens will discontinue the relevant processing, take reasonable measures to delete or restrict the data, and assess whether action is required under the GDPR, including notifying the affected individuals or the supervisory authority.

Transparency of AI-Generated Content

Code Gardens discloses material use of AI in a way that enables the audience to understand the origin of the material. Depending on the format, this may take the form of a caption, a note accompanying the publication, text placed next to an image or video, a statement in the project description, or a general notice on the relevant page.

The following additional rules apply:

material constituting a deepfake is labelled as artificially created or altered at the time of publication;
if an AI system provides machine-readable provenance labelling, Code Gardens does not intentionally remove it, except when removal is technically necessary and the required disclosure is preserved;
ordinary technical processing, such as colour correction, cropping, or spelling correction, is not in itself presented as AI-generated content.

If a visitor believes that material should be labelled more clearly, they may submit a link to the material using the contact form. Code Gardens will review the request and correct the labelling where necessary.

Intellectual Property and Personality Rights

When using AI, Code Gardens aims to:

use input materials only when it has the right or permission to use them;
avoid intentionally creating misleading imitations of real people, events, brands, or protected works;
check the result for recognisable trademarks, elements of third-party works, likenesses of individuals, and other evident legal risks;
not claim that an AI-generated result is unique or protected by exclusive copyright.

Rights relating to materials created for a client project are determined by the applicable agreement and applicable law. The use of AI does not remove the client’s obligation to confirm that they have the necessary rights to the source materials they provide.

Non-Discrimination, Quality, and Safety

Code Gardens recognises that AI may reproduce stereotypes and systematic errors. When reviewing materials, Code Gardens assesses unjustified generalisations, discriminatory wording, distortion of facts, dangerous instructions, unlawful content, and misleading representations of a product’s capabilities.

Access to work-related AI accounts is granted only to individuals who need it to perform their tasks. Code Gardens takes account of the settings made available by the provider, including settings concerning prompt history, the use of data to improve models, and content deletion. More restrictive settings are selected when they are available and compatible with the task.

Client Training

In its training programmes, Code Gardens addresses not only methods for achieving results but also the limitations of AI, fact-checking, data protection, copyright, transparency, and the need for human oversight.

Participants are advised to:

not enter personal or confidential information into educational or publicly available AI tools;
verify facts and sources regardless of the confident tone of an AI-generated response;
take account of relevant rules and laws, applicable law, and the requirements of their industry;
label AI-generated content when required by law, an agreement, or the context in which the content is published.

Training examples do not constitute individual legal, medical, or financial advice. Participants are independently responsible for their subsequent use of the selected AI service and its outputs.

Questions about this Policy, requests concerning the labelling of AI-generated content, and reports of possible errors may be sent to codegardens.info [ @ ] google.com. The enquiry should preferably include a link to the relevant material and a brief description of the issue.

Questions concerning personal data and the exercise of data subject rights are handled in accordance with the Code Gardens Privacy Policy and the GDPR.

Changes to This Policy

Code Gardens reviews this Policy when its methods of using AI, service providers, website functions, or applicable legislation change. A new version will be published on the website together with its effective date.
